Terms & Conditions

1.     Introduction


PROVIDER


Kapital Media London Limited (“Kapital Media”, “we”, “our” and “us”) is a company registered in England and Wales. Our company registration number is 10593198 and our registered office is at Unit 3b, Berol House 25 Ashley Road, Tottenham Hale, London, United Kingdom, N17 9LJ. Our VAT number is 305354332. By submitting an entry (“Entry”) to our Young Lions Competition (the “Competition”), you (“Entrant”) agree to be bound by these Terms and Conditions (“Terms”).


We may vary these Terms from time to time, in which case the variation will take effect from the date of publication of the new Terms on https://younglions.mediacat.com/(“Competition Website"). We have absolute discretion to determine the application of the Terms or to resolve any ambiguity in them as we see fit.


These Terms should be read in conjunction with the Young Lions Eligibility and General Rules (“Entry Kit”), available at: https://younglions.mediacat.com/young-lions/

2.     Submission of Entries


2.1.  Entries must be submitted following the process, rules and entry criteria set out in the Entry Kit.


2.2.  In order to create an Entry, Entrants will need to visit the Competition Website, register an account and complete the online Entry Form. This will generate the applicable fee for the Entry, which Entrants must then pay online by credit or debit card. Our acceptance of an Entry will take place upon successful completion of the payment.


2.3.  Entrants are solely responsible for selecting the correct Categories when creating an Entry. Once the Categories of an Entry have been selected and the Entry has been paid for, the Categories of the Entry cannot be amended by the Entrant.


2.4.  Entries cannot be amended in any way once they have been finally submitted and paid for.


2.5.  The deadline for Entry submissions is 20 April 2023. Entrants will have until the submission deadline to finalise and submit their Entries.


3.     Eligibility of Entries


3.1.  The Young Lions Competition is open to young professionals employed by an advertising company or agency, PR company or agency, media industry company or marketing company in Turkey, who are at least eighteen (18) years of age at the time of registration and who will not be older than thirty (30) years of age as of June 23, 2023.


3.2.  Freelancers and in-house creative teams from client companies will be accepted in relevant categories if they fit within the age and profession criteria.


3.3.  Each team must be made up of two professionals.


3.4.  The team partners do not have to be employed at the same company.


3.5.  Teams are only able to compete in one competition at Cannes Lions even if the dates of the competitions do not overlap.


3.6.  Teams that won the competition in previous years may compete in Young Lions Competitions Turkey 2023.


3.7.  Teams must submit their material anonymously bearing only their team number and team members’ names. Any reference to their company names will be a reason for disqualification.


3.8.  Teams who do not submit their work by the competition deadline or otherwise do not adhere to the rules set herewith may be disqualified at the Cannes Lions Representatives discretion.


3.9.  Teams must be able to submit and present their entry in English.


3.10.      Winners are responsible for obtaining any passport and visas necessary to travel to France.


3.11.      No work that has been held by a relevant authority to be in breach of any laws, regulations, or industry recognised codes of practice of the territory/territories in which it ran may be entered into the Awards. In the event that the work comprising an Entry that has been awarded at the Awards is held by a relevant authority to be in breach of any applicable laws, regulations, or industry recognised codes of practice, we reserve the right to withdraw the award and publicly announce the withdrawal.


3.12.      If, after submission of an Entry, the Entrant becomes aware that the Entry has infringed any rights (including, without limitation, intellectual property rights, privacy rights and other rights) of any person or any applicable laws, regulations, or industry recognised codes of practice, the Entrant shall contact Kapital Media immediately to request the withdrawal of the Entry from the Competition.


3.13.      We reserve the right to request additional information about an Entry, including for the purposes of verifying its eligibility. Entrants must ensure that they are reasonably available for, and respond promptly to, inquiries from Kapital Media regarding their Entries from the date of submission of their Entries through to the presentation of the awards.


3.14.      It is believed that the ideas of the works participating in the competition are original. Responsibility for originality is up to the applicant. If the jury notices that there is a problem with originality, it has the right to dispose of the submitted work from the competition.


3.15.      In case of any doubt about whether the advertisements meet the conditions of participation on our website or in which category they will compete, the final decision is made by the competition jury. The decision of the competition jury is final.


3.16.      All entries are final and not eligible for a refund.


 


4.     Cost of Entry


4.1.  A fee of €200 (including VAT) will be applied for each team for each category.


4.2.  The applicable fee for an Entry must be paid as set out in clause 2.2. of these Terms.


4.3.  The Entrant is solely responsible for ensuring that the applicable fee for an Entry is paid in full.


5.     Judging


5.1.  Entries will be judged by the Competition Jury which is composed of panels of selected judges. A list of the judges can be viewed on the Competition website when ready.


5.2.  The Competition Jury will consider all Entries using the judging criteria agreed for each category.


5.3.  Entries will be judged on the basis of the information and materials submitted. Judging will take place in April 2023.


5.4.  The decisions of the Competition Jury are final. No correspondence will be entered into with Entrants concerning any judging decision.


5.5.  The winners of the competition will be announced at the award ceremony and on mediacat.com.


6.     Intellectual Property


6.1.  By submitting an Entry the Entrant warrants and represents that:


a)     the Entry: i) is original to the Entrant; ii) does not infringe any copyright, database right or trademarks of any third party or breach any obligations of confidentiality, right of privacy, publicity or personality or any other right whatsoever of any third party and is not otherwise contrary to any applicable laws, regulations or industry recognised codes of practice; iii) does not contain any libellous, offensive, discriminatory or otherwise unlawful content; iv) is not likely to bring Kapital Media, the Awards, the Entrant or any other Entrant into disrepute; and v) is true and accurate in all material respects and complies fully with these Terms and the Entry Kit.


b)    the Entrant is the sole owner of the entire right, title and interest in and to the Entry (including all intellectual property rights therein) or it has obtained all necessary consents from the owner of the Entry as shall be required for the submission of the Entry into the Awards.


6.2.  By submitting an Entry, the Entrant fully and unreservedly grants Kapital Media a royalty-free, irrevocable, perpetual, worldwide, non-exclusive and fully sub-licensable licence to use, reproduce, publish, distribute, perform, display, create derivative works from, and otherwise exploit the Entry, including any material that forms part of the Entry, in whole or in part, in any form, including for promotional or marketing purposes.


6.3.  Entries, will not be considered to be confidential information unless any specific information contained within an Entry is marked as confidential. Entrants may not mark their entire Entry as confidential information.


7.     Data Protection


7.1.  Personal data submitted to, or collected by, Kapital Media in connection with the submission of Entries will be processed by Kapital Media for the purposes of conducting, administering and marketing the Competition. Kapital Media has a valid legitimate interest in processing such personal data for these purposes.


7.2.  By submitting an Entry, the Entrant acknowledges that the Entrant has read and understood Kapital Media’s Privacy Policy which is accessible at https://younglions.mediacat.com/ and which applies to the processing of any personal information by or on behalf of Kapital Media in connection with these Terms and the Awards.


8.     Cancellations


8.1.  The Entrant may withdraw the Entry at any time. However, after the application fee is processed and approved in the system, the fee cannot be refunded. At this point, the Entry will not be presented to the members of the jury, and the Entry will not be published anywhere.


8.2.  If the Entrant wishes to withdraw an Entry for any reason, the Entrant must give us written notice by email to younglions@kapital.com.tr or via the Contact page on the Competition Website at https://younglions.mediacat.com/ providing sufficient detail to enable us to identify the relevant Entry.


9.     Indemnity


9.1.  The Entrant shall indemnify Kapital Media and keep Kapital Media fully indemnified on demand from and against all losses and all actions, claims, proceedings, costs and damages (including any damages or compensation paid by Kapital Media on legal advice to compromise or settle any claim) and all legal costs or other expenses arising out of any breach of any of the warranties and representations contained in these Terms or out of any claim by a third party based on any facts which if substantiated would constitute such a breach.


9.2.  Kapital Media shall have no liability under or in connection with these Terms, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, for any consequential, indirect or special damages (including indirect loss of profit and indirect loss of revenue).


9.3.  Nothing in these Terms shall limit or exclude either party’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot be limited or excluded as a matter of applicable law.


10.  Force Majeure


10.1.      Kapital Media shall not be in breach of these Terms nor liable for delay in performing, or failure to perform, any of its obligations under these Terms if such delay or failure result from events, circumstances or causes beyond its reasonable control.


11.  Entire Agreement


11.1.      Each Entrant acknowledges and agrees that these Terms constitute the entire and only agreement between the Entrant and Kapital Media. No Entrant has relied upon, nor has been given by Kapital Media, any warranty, representation, statement, assurance, covenant, agreement, undertaking, indemnity or commitment of any nature whatsoever other than as expressly set out in these Terms.


11.2.      Should any provision of these Terms be deemed illegal or otherwise unenforceable, that provision shall be severed and the remainder of these Terms shall remain in full force and effect.


12.  Third Party Rights


12.1.      A person who is not a party to these Terms shall not have any rights under or in connection with them.


13.  Governing Law


13.1.      These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
